PUBLIC AGREEMENT (OFFER) ON THE PROVISION OF A CHARITABLE DONATION<\/strong><\/p>\n

This Public Offer for a charitable donation (hereinafter referred to as the Offer) is aimed at an indefinite number of individuals (hereinafter referred to as the Donor) and is a public offer Charitable Organization “Charitable Foundation “Cossack Drive”<\/strong>, represented by the Chairman of the Foundation Mr. Volodymyr Penev, acting on the basis of the Charter (hereinafter referred to as the Foundation), to conclude an agreement on the provision of a charitable donation on the terms and conditions specified below:<\/p>\n

  1. Terms and definitions used in the Agreement<\/em><\/strong><\/li>\n<\/ol>\n

    Public offer<\/strong> is a valid offer of the Foundation posted on the website: https:\/\/www.kozakdrive.charity\/en\/about\/, to provide a charitable donation aimed at an indefinite number of individuals.<\/p>\n

    Acceptance<\/strong> means full and unconditional acceptance of the Offer by taking actions aimed at making a money transfer using payment forms and means, both posted on the website and by transferring funds to the current account of the Fund through bank institutions. The offer shall be deemed accepted from the date of crediting the funds to the current account of the Fund.<\/p>\n

    Charitable donation<\/strong> is voluntary and non-refundable and means a gratuitous transfer of funds by the Donor to the Foundation for subsequent transfer to the Beneficiaries to achieve certain charitable purposes provided for by the Charter or programs of the Foundation in accordance with the Law of Ukraine “On Charitable Activities and Charitable Organizations”, the Charter of the Foundation and this Agreement. Donation is voluntary and non-refundable.<\/p>\n

    A philanthropist<\/strong> is a legally capable individual who voluntarily carries out one or more types of charitable activities. For the purposes of this Agreement, the Donor is an individual who has accepted the Offer.<\/p>\n

    Beneficiary<\/strong> is a recipient of charitable assistance who receives assistance from one or more Donors to achieve the goals set forth in the Law of Ukraine “On Charitable Activities and Charitable Organizations” and the Foundation’s Charter.<\/p>\n

      \n
    1. Subject of the Agreement<\/em><\/strong><\/li>\n<\/ol>\n

      The subject matter<\/strong> of this Agreement is a gratuitous and voluntary transfer by the Donor to the Foundation by way of a charitable donation to ensure the provision of charitable assistance by the Foundation in accordance with the Law of Ukraine “On Charitable Activities and Charitable Organizations”, the Charter, the Foundation’s programs, etc. The Foundation independently determines the amount and directions of use of the charitable donation in accordance with its statutory activities and programs of the Foundation. The parties’ performance of this Agreement is not intended to generate profit or any benefits for either party.<\/p>\n

      1. Goals and areas of charitable activity<\/strong><\/em><\/li>\n<\/ol>\n

        The objectives and areas of the Foundation’s charitable activities are defined by the Law of Ukraine “On Charitable Activities and Charitable Organizations”, the Law of Ukraine “On Humanitarian Aid”, and the Foundation’s Charter.<\/p>\n

          \n
        1. Acceptance<\/em><\/strong><\/li>\n<\/ol>\n

          By acceptance<\/strong> The Benefactor hereby declares that he\/she agrees to all the terms and conditions of the Offer, which he\/she has read on the website https:\/\/www.kozakdrive.charity\/en\/about\/. In addition, by accepting the Offer, the Donor fully understands and agrees with the subject matter of this Agreement, the purposes of public fundraising, and confirms the right of the Foundation to use part of the Charitable Donation for the Foundation’s administrative expenses in the amount not exceeding the amount specified in the Law of Ukraine “On Charitable Activities and Charitable Organizations”.<\/p>\n

          The Parties agree that from the moment of acceptance of the Offer, this Agreement is concluded in writing in accordance with Articles 207, 639, 641 and 642 of the Civil Code of Ukraine and Article 7 of the Law of Ukraine “On Charitable Activities and Charitable Organizations”. The parties agree that after acceptance, failure to sign this Agreement in the form of a separate document shall not invalidate this Agreement.<\/p>\n

            \n
          1. Rights and obligations of the Fund<\/em><\/strong><\/li>\n<\/ol>\n

            The Foundation has the right to:<\/strong><\/p>\n

              \n
            • receive Charitable Donations and use them in accordance with the subject matter and terms of this Agreement and its statutory activities;<\/li>\n
            • to use a part of the Charitable Donation for the administrative expenses of the Foundation in the amount not exceeding the amount provided for by the Law of Ukraine “On Charitable Activities and Charitable Organizations”.<\/li>\n<\/ul>\n

              The Foundation is obliged:<\/strong><\/p>\n

              • report on the use of Charitable Donations by posting relevant information on the website: https:\/\/www.kozakdrive.charity\/en\/about\/.<\/li>\n<\/ul>\n
                  \n
                1. The rights of the Benefactor<\/em><\/strong><\/li>\n<\/ol>\n

                  The benefactor has the right:<\/strong><\/p>\n

                    \n
                  • to control the use of the Charitable Donation by the Foundation for its intended purpose.<\/li>\n<\/ul>\n
                      \n
                    1. Place of public fundraising<\/em><\/strong><\/li>\n<\/ol>\n

                      The public fundraising of the Charitable Donation is carried out in any country of the world. The Foundation’s direct activities related to public fundraising are carried out at the location of the Foundation.<\/p>\n

                      1. Fundraising period<\/em><\/strong><\/li>\n<\/ol>\n

                        Public fundraising continues until the Foundation ceases to operate (including through liquidation), unless another term is determined by the decision of the Foundation, about which the Benefactor will be notified by posting relevant information on the website: https:\/\/www.kozakdrive.charity\/en\/about\/<\/p>\n

                        1. Procedure for using charitable donations<\/em><\/strong><\/li>\n<\/ol>\n

                          Charitable donations are used to ensure the achievement of the goals set out in the Foundation’s statutory activities and the current legislation of Ukraine, in particular the Law of Ukraine “On Charitable Activities and Charitable Organizations”.<\/p>\n

                          The Foundation uses the Charitable Donations in accordance with its statutory activities and programs of the Foundation.<\/p>\n

                            \n
                          1. Responsibility of the Fund<\/em><\/strong><\/li>\n<\/ol>\n

                            The Foundation shall be liable for violation of the terms of this Agreement and use of Charitable Donations contrary to the procedure provided for by the statutory activities of the Foundation and the legislation of Ukraine, in accordance with the current legislation of Ukraine.<\/p>\n

                              \n
                            1. Changes to the terms of the Public Offer<\/strong><\/li>\n<\/ol>\n

                              The Fund has the right to make changes to this Public Offer. All changes will be published on the website https:\/\/www.kozakdrive.charity\/en\/about\/ at least ten days prior to the effective date of the changes.<\/p>\n

                              When changes to the terms of the Public Offer come into force, the consent of the Benefactor is not required.<\/p>\n","protected":false},"excerpt":{"rendered":"
